Polyforge is a service operated by NEW TUANCHE COLORADO INC ("Polyforge", "we", "us"). These Terms of Service ("Terms") govern your access to and use of Polyforge's websites, Creator Suite and API (collectively, the "Service"). By using the Service you agree to these Terms.
Acceptance of terms
By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
Eligibility & accounts
You must be at least 13 years old, or the age of digital consent in your jurisdiction, to use the Service.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
Use of the Service
You may use the Service to generate image, video, audio and text content, subject to these Terms. You must not misuse the Service, interfere with its operation, or access it through unauthorized means.
Credits & billing
The Service is offered on a pay-as-you-go basis using credits. Credits are deducted per generation and, unless stated otherwise, do not expire. Fees are non-refundable except where required by law.
Your content & ownership
You retain ownership of the prompts you submit and the original outputs you generate, to the extent permitted by applicable law.
You are responsible for ensuring that your inputs, and your use of any outputs, do not infringe the rights of any third party.
Acceptable use
You agree not to use the Service to create unlawful, infringing, deceptive or harmful content, or content that violates the rights of others. We may suspend access for violations.
Third-party models & disclaimers
The Service aggregates third-party models whose providers may impose additional terms; availability may change. Routing and failover are provided on a best-effort basis.
The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Polyforge is not liable for indirect, incidental or consequential damages.
Governing law
These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws rules. Any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Colorado.
